Terms of Service
These terms govern the use of the Munot service provided by K-I-Soft IT&Holding GmbH ("we", "K-I-Soft").
1. Scope
These terms apply to registration for and use of Munot. Deviating terms of the user (“Customer”) apply only with our express written consent.
2. The service
Munot is a cookieless web traffic analytics service: it analyses the CloudFront access logs of the websites you connect, classifies the traffic (human, search engine, AI crawler) and presents aggregated metrics and guidance in a dashboard. Features and availability may evolve.
3. Account and registration
Use requires an account. The Customer provides accurate information, keeps credentials confidential and is responsible for activity under their account.
4. Acceptable use
The Customer must not misuse Munot — in particular not unlawfully, not to impair the service, and not by circumventing access or security mechanisms.
5. Customer obligations and data processing
By connecting websites, the Customer has their access logs processed by Munot. These logs may contain personal data of website visitors (e.g. IP addresses). The Customer warrants that it is entitled to have this data processed by K-I-Soft and that it ensures the required legal basis and information towards its visitors. For this data the Customer is the controller; K-I-Soft acts as a processor on the Customer’s instructions and solely to provide the service.
6. Availability
We aim for high availability but do not owe any specific level of availability. Maintenance, ongoing development and faults may cause interruptions.
7. Pricing
The service may be provided free of charge or for a fee; the offer agreed or shown at the time of ordering applies. Any fees are exclusive of statutory VAT.
8. Warranty and liability
Munot is provided with reasonable care but without any assurance as to the completeness or accuracy of the analyses. To the extent permitted by law, K-I-Soft’s liability is limited to intent and gross negligence; liability for slight negligence, indirect damage and consequential damage is excluded.
9. No guaranteed results
Guidance and metrics in the dashboard are decision aids. Munot does not guarantee any particular reach, ranking or discoverability — create the conditions and make them verifiable, not guaranteed.
10. Data protection
The processing of personal data is governed by the Privacy Policy.
11. Term and termination
The Customer may close their account at any time. We may suspend or terminate use in case of breach of these terms. On termination, access to the dashboard ends; stored data is deleted in line with the Privacy Policy.
12. Changes
We may amend these terms. The version published here at any time applies.
13. Governing law and jurisdiction
Swiss law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Bern, Switzerland, unless mandatory provisions require otherwise.
